Duckpond Pixelz Terms of Use

I reserve the right to refuse membership to anyone that I see fit. If you are a member
and don't follow my terms I reserve the right to take you out of the members area without
refund. There are NO refunds for any reason. Once you pay through paypal you are a member of this
site an do not get a refund.

You will not get access to the site until you have posted your logo and/or license with a link
back to duckpond pixelz. Once you send me an email that you have it linked and online is when I will
add you to the members area.

ANYTHING you use on this site must be linked back to http://duckpondpixelz.com NOT http://duckpondpixelz.com/whatever
You must link your LOGO (or a text link is fine) to the MAIN site. If after your membership expires
and you do not renew you must keep a link back to me on your site if still displaying
bought or created material from this site.

You may NOT give our your username and password to ANYONE. Nor can you share anything here
in its original form, like tubes, lines etc. These are for Members only, if someone wants something
they can join the site. IF you have a FREE site, you may give them away for free BUT they must be
behind a password protected members area, not for all to take and do as they please. And you must
link back.

Your site may not contain any racisim, hatred, pornography, or anything promoting wrong doing or illegal activities.

I hold all copyright to MY work. Those that purchase a tube license are buying a license to USE
my work, not to get copyright of my work. Tubes that are NOT my work are given full credit on each and
every page in the members area.

You MUST have a website to join. UNLESS you know me personally or you are referred by a friend or member of mine.

If you are caught Hotlinking (http://altlab.com/hotlinking.html) you will be permanently banned from this site. No
refunds, no second chances. This is an illegal act and it sucks my bandwidth for all the other
members of this site.

There is a mailing list that is mandatory to join. I have found that it is quite hard to get
all the members some important info. So as of now once you join the members area you have 5
days to join the udpate list or be suspended until you do so.

IF you are trying to join and I have found out that you have broken another artists TOU then you will
NOT become a member of my site. I do not take this lightly and I stand behind all other pixel
artists in this community. IF You are a current member of my site and you have or are breaking
another artists TOU and you know full well you have you will be banned from this site and I will
tell you to not use anything from my site. IF it was just a one time thing, an accident that is one thing
accidents and mistakes happen, I know. You will not be punished for an accident. I will use my judgement
on the matter.

I offer Tube and Tutorial licenses. Joining my site you can automatically make profit on
anything you make there is no need to purchase a separate for profit license. To be able to tube
my lineart you will have to have a Tube license. If you want to make tutorials you will have to have
a tutorial license. Otherwise there is no tube or tutorial writing allowed.

This license does NOT give you the right to alter the lines in anyway
- You MAY however change adding other faces but it still does not make it yours.
You may add these to your members area AS IS.
Your members can tube them per YOUR terms not mine.
Your members may NOT put these in their members area as is
You may NOT sell these in packs As IS they must be colored in order to sell them.

This As Is license is good for ALL lineart currently in the members
area and all lineart to come

EXCLUDING... Custom Lines & As Is Lines (Per the original artists terms)
They are clearly marked in the lineart section.

You are welcome to use the lines in more then one website that you own, BUT
you can't put the same lines in more then one website. For example, if you
decide that you want to put the Nienna Series in Site A then you cant put any
from that seres in Site B. You must keep the Series together in each site.
You could put the Nienna Series in Site A, and the PJs Series in Site B etc.
All terms must be followed for all sites, and you will need to give me each site
name and you will have a separate license for each site.

If you have a co-owner you are allowed to still purchase this license and put it
in your co-member area. Your co-owner IS allowed to tube these lines on Your website
since you hold the As Is license and per your sites TOU they can tube the lines if
you so wish.

I reserve the right to sell this license again at a later date if I so choose.
After the 5 are sold the Nienna lines will no longer be included in the AS IS license.

You are allowed to alter any lines in the member area that I have drawn. The final outcome must be changed 50% or more. Basically if I look at the line, I have to be able to not recognize it as mine. After you have changed it 50% or more you are free to do whatever you want. Put them in your members area, sell them as is, tube them. Whatever you'd like. You must place your line alter license on your membership pages linked back to http://duckpondpixelz.com at all times. If you are unsure of something or have any questions just ask. If you are unsure, then don't do it :) The price for current members of dpp is $40.00.

I do not require access to your members area, but If there are any questions on you
or your site I will ask that I can come in and see that my terms are being met.

NOTHING is to be shared/passed through yahoo/google/msn groups. This is a HUGE no no!

This license allows you to tube my original lineart and place it in your members area "As Is". This
license also allows you to sell tube packs made from my original lineart "As Is". The ONLY lineart
that is allowed in this license that is under the category "Original". This section is clearly marked
and only these lines are allowed in this license.

You may make end use products with my lineart, including sigtags, websets, IM stationary etc
Nothing on my site is to be tubed unless you own a tube license. The only people to have
an As Is license for my lineart are posted Above in the As Is terms. Some lineart that was
purchased in the purchaseware section is in the members area and some do have an as is license
JUST for that lineart specificially.

As of now I do NOT allow line altering. If you are interested please email me.You can do minor changes to suit your needs for sigtags but you may not change them and make them into tubes or call them your own. They are my lines and even if you change them a little they are not yours.

You may not offer ANY lines in your members area UNLESS you own an As Is license.
If you are found misusing my lineart or any terms here you will be asked to take them down
immediately and have your members STOP using them all together. If this does not happen
you will be kicked out of the members aea.

My lineart is NOT to be resized. If you need something smaller or bigger just email me and
I will see what I can do.

YOu may NOT use pieces of one lineart to add to another. That is frankendolling and is NOT
permitted!!

You may use the tubes for end use products like sigtags, websets, IM stationary etc. You
may not make lineart out of my tubes. You may NOT retube my tubes. NO recoloring is allowed.

You must add something other then text to the tubes. That is just not creative and thats why we
are here is to be creative. you must add props and other things to make it creative not just text.

*NEW* You may not have anyone color my lineart for you, You may not let anyone recolor tubes you
have made with my lineart. You may not recolor MY tubes. You color in your own lineart and thats it.
You use my tubes or if you don't like the colors then don't use them. No one but you is allowed to
alter the stuff in the members area. If you offer a recolor license please do NOT include stuff you have
Made or purchased from my site.

1. Tutorials where you draw the lineart and color it in yourself. You may NOT add the lineartr
to your members area, after you color it in IF you own a tube license, you may add the finished
tube to your members area.

2. Tutorials where you learn how to color it. These lines may NOT be added to your members area
but the finished product may be added as a tube to your members area IF you hold a tube license only

Dolls may be changed SLIGHTLY for animation purposes but not so much that it distorts the
whole tube or changes it totally. SOME tubes you may change the skin/hair/eye colors. They will
be clearly marked, otherwise nothing is to be changed.

Bases must be FULLY dressed or have at least hair, and a bathing suit on. No naked bases are
allowed to be put in your members area. If a doll has a name you are NOT allowed to change it
I am not the best with coming up with names but when I do they are meaningful to me and are
not to be changed.

These must stay INTACT. yOu may change them to go with your OE stationary but all the links
must stay the same and intact.

You may request THREE(3) sig tags per week for you or anyone else. They MUST be linked back to
http://duckpondpixelz.com You may use them in emails, forums, on your site etc. As long as there
is a link back. Requests for sigtags can be sent any day of the week but I will only fill sig tags
on my days off which differ every week but are promised within One(1) week of requesting.

If you are a co-owner of a site both owners aer NOT required to join. BUT if the other owner
Wants to use my work and get into the members area they MUST purchase a membership. IF all
site owners would like to join the 2nd site owner may join for 25% off their membership price.
You may NOT share memberships! NO NO NO! Only the purchaser of the membership may use and login
to the members area and anything that is inside of it. If you have any questions please email me.

Anything you create you may use to make an auction. But a link in the auction must say
where you got the lines/tubes/etc from. If you use a doll base of mine you must say
Base by http://duckpondpixelz.com etc.

I also trade line packs, tube packs etc. Please just contact me if you are wanting to do this
If you do not update at Least Once a month our trade will be ended Unless there is a personal
Emergency or on break for a holiday.

Members get a discount of 20% off anything in the store. My purchaseware prices are really
low. You must have an order total of $10.00 or more before adding the discount to use the 20% off.

Licenses for the lines in the purchaseware area are noted. IF you own a tube license you do NOT
need to purchase another license. BUT if you wish to buy something As Is you must purchase that license.
IF you hold an As Is license you do NOT have to purchase the as is or tube license for the lines
in the purchaseware section. You MUST at ALL times LINK BACK! http://duckpondpixelz.com

I reserve the right to change my terms as I see fit. If you are a current member and I change
my terms, you are to follow the terms that you joined under UNLESS it is something big
that I need ALL members to follow and that will be noted in the change.

These terms apply to EVERYONE that has purchased, traded, gifted, or won a membership at my site.
